This Privacy Policy describes how Trusti LLC ("REA.ai," "we," "us," or "our") collects, uses, shares, and protects your personal information when you use our website, platform, applications, and services (collectively, the "Service").

By using the Service, you consent to the data practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Service.

1. Information We Collect

We collect information in three ways: (1) information you provide directly to us, (2) information we collect automatically, and (3) information from third-party sources.

1.1 Information You Provide to Us

When you use the Service, you may provide us with the following types of information:

Account Information: Name, email address, phone number, company/agency name, real estate license information, job title, billing address, and payment information.

Profile Information: Professional biography, profile photo, business location, areas of specialization, and website or social media links.

Customer and Lead Data: Contact information for your customers and leads, communication histories, lead sources and status, property preferences, appointment information, and feedback.

Communications: Messages and conversations with the REA AI assistant, support requests, and user-generated content.

1.2 Information We Collect Automatically

When you access or use the Service, we automatically collect device information (IP address, device type, browser type), activity information (pages accessed, interactions, search queries), location information, and data from cookies and similar technologies.

1.3 Information from Third-Party Sources

We may receive information about you from third parties including integration partners (CRM systems, email marketing platforms, MLS platforms), business partners, publicly available sources, and payment processors.

2. How We Use Your Information

2.1 Provide and Improve the Service

We use your information to create and manage your account, deliver Service features, process transactions, provide AI assistant capabilities, generate insights and reports, personalize your experience, and respond to your requests.

2.2 Service Improvement and Development

We analyze usage patterns, conduct research and development, improve and optimize the Service, develop new features, and train AI models and algorithms.

2.3 Communication

We send administrative messages, provide customer support, send marketing communications (with your consent where required), and conduct surveys.

2.4 Safety and Security

We verify identity, detect and prevent fraud, protect against security threats, enforce our Terms of Service, and protect our rights and those of our users.

2.5 Legal and Compliance

We comply with applicable laws, respond to lawful requests, establish legal claims, and conduct audits.

2.6 Aggregated and Anonymized Data

We may aggregate and anonymize your information to create statistical data. We may use and share this anonymized data for industry research, benchmarking, product development, and marketing purposes.

3. Third-Party AI Service Providers and Data Processing

3.1 Overview

The Service relies on third-party artificial intelligence providers to deliver core functionality, including natural language processing, conversational AI, content generation, sentiment analysis, lead qualification, and predictive analytics.

3.2 Third-Party AI Providers

We currently use or may use Large Language Model (LLM) Providers (including OpenAI, Anthropic, Google), cloud AI services (Microsoft Azure, AWS, Google Cloud), specialized AI tools, and analytics platforms. The specific providers we use may change over time.

3.3 Data Shared with AI Providers

When you use the Service, the following types of data may be shared with third-party AI providers: input data (messages, prompts, queries), output data (AI-generated responses), usage and performance data, and technical data (IP addresses, device identifiers).

3.4 How Third-Party AI Providers Use Your Data

Third-party AI providers may use your data for service delivery, service improvement (including training and fine-tuning models), operational purposes, and anonymization and aggregation.

3.5 Specific Provider Information

3.6 Risks and Limitations

Data Retention: Third-party AI providers may retain your data for varying periods. Some retain data for 30 days, others longer.

Anonymization Risks: While providers attempt to anonymize data, no method is foolproof. There is a theoretical risk of re-identification.

Third-Party Control: We do not control third-party providers' data practices. Providers may change their policies or practices.

International Transfers: Your data may be processed in the United States or other countries. Data protection laws may differ from your jurisdiction.

3.7 Your Choices

To protect your privacy: Do not submit highly sensitive information (SSN, financial account numbers, medical information). Use privacy-focused features where available. Review data before submission. Contact us at hello@trusti.com to discuss enterprise options.

4. How We Share Your Information

4.1 Third-Party Service Providers

We share information with third-party service providers who perform services on our behalf, including AI providers, cloud hosting (AWS, Google Cloud, Azure), payment processors (Stripe, PayPal), customer support tools, email services, analytics providers, marketing platforms, and security services. These providers are contractually obligated to protect your information.

4.2 Business Transfers

If we are involved in a merger, acquisition, sale of assets, or other business transaction, your information may be transferred. We will notify you of any change in ownership or use of your personal information.

4.3 Legal Requirements and Protection

We may disclose your information if required by law or in response to legal processes, government requests, national security requirements, or to protect our rights and those of our users.

4.4 With Your Consent

We may share your information when you explicitly consent or authorize integrations with third-party services.

4.5 Aggregated and Anonymized Data

We may share aggregated, anonymized, or de-identified data that cannot identify you with business partners, advertisers, researchers, and the public.

5. Data Retention

5.1 Retention Periods

Active Accounts: We retain your information as long as your account is active.

Inactive and Closed Accounts: After account closure, we retain data for up to 30 days for recovery purposes. After 30 days, we delete or anonymize your data. Some data may remain in backups for up to 90 days.

Legal and Compliance: We may retain information longer when required by law. Billing and transaction records: 7 years. Legal hold: Indefinitely when required for litigation.

Anonymized Data: Anonymized and aggregated data may be retained indefinitely.

5.2 Deletion Requests

You may request deletion of your personal information at any time (subject to legal requirements). See Section 7 for information about your privacy rights.

6. Data Security

6.1 Security Measures

We implement industry-standard security measures including encryption in transit (TLS/SSL), encryption at rest, secure authentication, regular security audits, intrusion detection systems, firewall protection, employee training, access controls, and confidentiality agreements.

6.2 Third-Party Security

We select service providers that maintain appropriate security measures. However, we cannot guarantee the security practices of third parties.

6.3 Limitations

No method of transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

6.4 Data Breach Notification

In the event of a data breach, we will notify you as required by applicable law (typically within 72 hours), describe the nature of the breach, and provide recommendations to protect yourself.

7. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information:

Access and Portability: Request a copy of your personal information or receive it in a structured, commonly used format.

Correction: Request correction of inaccurate or incomplete information.

Deletion: Request deletion of your personal information (subject to legal requirements).

Objection and Restriction: Object to certain processing or request restriction of processing in certain circumstances.

Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time.

Marketing Communications: You may opt out of marketing emails by clicking "unsubscribe" or adjusting your account settings.

Response Time: We will respond to your requests within 30 days (or 45 days if extension is needed).

8. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).

California Residents May: Know what personal information is collected and used, delete personal information, correct inaccurate information, opt-out of sharing, and limit use of sensitive personal information.

We Do Not: "Sell" your personal information for monetary consideration.

9. European Privacy Rights (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR).

GDPR Rights Include: Access to your data, rectification of inaccurate data, erasure ("right to be forgotten"), restriction of processing, data portability, objection to processing, withdrawal of consent, and the right to complain to your data protection authority.

We process your data under: Contract performance, legitimate interests, consent, and legal obligations.

To exercise GDPR rights, email hello@trusti.com with "GDPR Request" in the subject line. We will respond within one month (extendable by two months if necessary).

International Data Transfers: We are based in the United States. If you access the Service from the EEA, UK, or Switzerland, your data will be transferred to the United States. We implement appropriate safeguards including Standard Contractual Clauses.

10. Children's Privacy

The Service is not intended for children under 18, and we do not knowingly collect personal information from children under 18. If you are under 18, do not use the Service or provide any personal information.

If we learn we have collected information from a child under 18, we will delete that information as quickly as possible. Parents or guardians who believe we have collected information from their child may contact us at hello@trusti.com.

11. International Data Transfers

We are based in the United States, and your information may be transferred to, stored, and processed in the United States and other countries where our service providers operate.

By using the Service, you consent to: Transfer of your information to the United States and other countries, processing in these countries, and application of U.S. law to disputes.

Safeguards: We implement appropriate safeguards for international transfers, including Standard Contractual Clauses (SCCs), adequacy decisions, and other lawful transfer mechanisms.

12. Cookies and Tracking Technologies

12.1 What Are Cookies?

Cookies are small text files stored on your device that help us provide and improve the Service. We use cookies, web beacons, pixels, local storage, and mobile device identifiers.

12.2 Types of Cookies We Use

Strictly Necessary: Required for the Service to function (authentication, security, payments).

Performance and Analytics: Collect information about how you use the Service (Google Analytics, Mixpanel).

Functionality: Remember your preferences and enable integrations.

Advertising and Marketing: Deliver relevant advertisements and support retargeting campaigns.

12.3 Managing Cookies

Most browsers allow you to control cookies through settings. You can block or delete cookies, but this may affect functionality. You can also opt out through Google Analytics, the Network Advertising Initiative, or the Digital Advertising Alliance.

On mobile devices, you can limit ad tracking through your device settings (iOS: Settings > Privacy > Advertising > Limit Ad Tracking; Android: Settings > Google > Ads > Opt out of Ads Personalization).

13. Do Not Track Signals

Some browsers have "Do Not Track" (DNT) features. We currently do not respond to DNT signals because there is no common industry standard. We will continue to monitor developments and may adjust our practices in the future.

14. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to our practices, laws, regulations, or new features. We will notify you of material changes by posting the updated policy on our website, updating the "Last Updated" date, sending an email, or displaying a notice on the Service.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Privacy Policy. If you do not agree to changes, you should stop using the Service and close your account.
